Terms of Service

These Terms govern the TomatoMC website, community features, Minecraft network and connected services. By creating an account or using an authenticated service, you agree to these Terms and the Server Rules.

1. Who operates TomatoMC

TomatoMC is operated by TomatoMC, based in the Netherlands. Contact us through the Support Center.

2. Eligibility and younger users

You must be legally able to accept these Terms. If you are under 16, use TomatoMC with the knowledge and involvement of a parent or legal guardian and obtain any permission required by law. Do not submit unnecessary sensitive personal information. A parent or guardian may contact us about a younger user's account or data.

3. Accounts and security

• Provide accurate account and verification information and keep it reasonably current.
• Keep your password, recovery codes and two-factor authentication secret. You are responsible for activity you knowingly authorise.
• Do not sell, share or transfer accounts, impersonate others, evade sanctions or create accounts to abuse the service.
• Tell us promptly through Support if you believe an account has been compromised.

4. Community and game rules

The published Server Rules, forum rules and feature-specific instructions form part of these Terms. They apply to Java and Bedrock players, the website, forum, support, applications, Discord-connected features and other TomatoMC community spaces. Do not cheat, exploit bugs, harass others, publish unlawful content, compromise systems or disrupt services. Report serious vulnerabilities privately instead of exploiting or publicly disclosing them.

5. User content

You retain ownership of content you submit, such as forum posts, profile information, ticket messages and attachments. You grant TomatoMC a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and moderate that content only as needed to operate, secure and improve the services. You confirm that you have the right to submit it. Public posts and public profile fields can be seen and copied by others; private tickets, applications and staff areas are limited to authorised users.

6. Moderation, enforcement and appeals

We may edit or remove content and warn, mute, suspend, ban or restrict accounts when reasonably necessary to enforce rules, protect users or systems, investigate abuse, comply with law or prevent harm. Severity, history, evidence and context may be considered. Where appropriate, we will explain a decision. You may appeal or report unlawful content through the Support Center. Immediate action may be taken where safety, security or legal obligations require it.

7. Minecraft and Discord verification

Verification links an account to a Minecraft UUID or Discord user ID. You may only verify an identity you control. Verification does not prove a person's civil identity. In-game rewards or commands triggered by verification, votes or gameplay have no cash value, are non-transferable unless explicitly stated and may be corrected when granted through error or abuse.

7A. Creator Program

Creator Program applications and participation are governed by the conditions shown before submission. Audience thresholds are minimum eligibility requirements and do not guarantee acceptance, payment, a rank or specific benefits. Accepted creators may receive conditional early access, exclusive worlds, ranks or collaboration support in exchange for agreed promotion and appropriate advertising disclosures. Statistics must be genuine; relevant conflicts and reputation issues must be disclosed. TomatoMC may review, limit or withdraw creator privileges for inactivity, dishonesty, abuse, confidentiality breaches, serious reputational risk or changed programme needs. Unless separately agreed in writing, participation is not employment and is unpaid.

8. Availability, changes and backups

Services are provided on a reasonable-efforts basis. Maintenance, updates, attacks, faults or third-party outages may cause downtime or data loss. We may change, suspend or retire features and game content. We do not guarantee uninterrupted availability, a particular game balance, permanent worlds, ranks, items or virtual progress. We take reasonable operational precautions, but you should retain copies of content that matters to you.

9. Third-party services

TomatoMC may link to or interoperate with Minecraft/Microsoft, Discord, Cloudflare, voting sites and other providers. Their own terms and privacy rules apply to their services. TomatoMC is an independent community and is not an official Minecraft service, and is not approved by or associated with Mojang Studios or Microsoft.

10. Store, checkout and digital delivery

Purchases are available only to users aged 16 or older. TomatoMC displays the catalogue and links each checkout to the verified Minecraft account shown before purchase. Product configuration, final prices, applicable taxes, payment methods, subscriptions, payment processing, fraud handling and the checkout agreement are provided by Tebex, which acts as merchant of record for purchases completed through its checkout. Review the package, player name, billing interval, total and Tebex Terms before paying. TomatoMC does not receive your card or bank credentials.

• Digital ranks, currency, keys, items and access are server entitlements with no cash value and may not be resold, transferred or exchanged unless expressly stated.
• Delivery is performed through the official Tebex game-server integration. Most purchases arrive automatically, but maintenance, an offline server or a provider delay may postpone delivery. Contact Support with the TomatoMC order reference instead of paying twice.
• Subscriptions renew and end under the billing information shown by Tebex. Cancellation normally stops a future renewal and does not automatically end the already-paid period.
• Refund, dispute and chargeback outcomes can remove or suspend the corresponding entitlement. Abusing payments, refunds or chargebacks may lead to account restrictions where lawful.
• Where immediate digital delivery requires acknowledgement concerning a statutory withdrawal right, that acknowledgement is collected in checkout. Nothing in these Terms limits mandatory Dutch or EU consumer rights.

11. Intellectual property

TomatoMC's original branding, website design, text and custom software are protected by applicable intellectual-property law. You may not copy, resell or misleadingly present them as your own. Third-party names, plugins, game assets and trademarks remain the property of their respective owners.

12. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for intent, fraud, death or personal injury where applicable. To the extent permitted by law, TomatoMC is not liable for indirect or consequential loss, loss caused by third-party services, or loss resulting from misuse or breach of these Terms. Mandatory Dutch and EU consumer protections remain unaffected.

13. Ending an account

You may stop using the services and request account deletion through Support. We may suspend or close an account for material or repeated breaches, security risk, legal requirements or discontinuation of the service. Provisions that logically survive closure—including licences needed for retained public posts, enforcement records, liability and disputes—continue only as necessary.

14. Changes to these Terms

We may update these Terms when services, law or operational practices change. The page shows the effective date and version. Material changes will be announced reasonably in advance through the website or account notice where practical. Continued use after the effective date means acceptance; where fresh consent or acceptance is legally required, we will request it.

15. Law and disputes

Dutch law applies, without depriving consumers of mandatory protections in their country of residence. We encourage you to contact Support first so a dispute can be resolved informally. Any court choice is subject to mandatory jurisdiction and consumer-law rules.
